1. Agreement to Terms

These Terms of Service ("Terms") constitute a legally binding agreement between you and Heyvento ("we," "us," or "our") governing your access to and use of the Heyvento digital guestbook platform.

By creating an account or using our services, you agree to be bound by these Terms. If you do not agree to these Terms, you may not use our services.

2. Description of Service

Heyvento provides a digital guestbook platform that allows event hosts to:

• Create digital guestbooks for events (weddings, birthdays, corporate events, etc.)
• Collect multimedia messages (text, voice, video, photos) from event guests
• Display messages on a live slideshow during events
• Manage and export collected content
• Invite co-hosts to collaborate on event management

Guests can leave messages without creating an account by accessing the event via QR code or direct link.

3. Account Registration

To create events as a host, you must register for an account. You agree to:

• Provide accurate and complete registration information
• Maintain the security of your account credentials
• Promptly notify us of any unauthorized use of your account
• Accept responsibility for all activities that occur under your account

You must be at least 18 years old to create an account. We reserve the right to suspend or terminate accounts that violate these Terms.

4. Subscription Plans and Pricing

Heyvento offers various subscription tiers with different features and limits:

• Free: Limited messages and storage for small personal events
• Starter: Increased limits suitable for medium-sized events
• Standard: Higher limits for larger celebrations
• Premium: Maximum capacity for large events

Paid subscriptions are billed on a per-event basis. Prices are displayed at the time of purchase and may change with notice.

Our order process is conducted by our online reseller Paddle.com. Paddle.com is the Merchant of Record for all our orders. Paddle provides all customer service inquiries and handles returns.

You may request a full refund within 30 days of purchase for any reason, no questions asked. To request a refund, contact us at admin@heyvento.com or through Paddle's buyer support. Refunds will be processed without undue delay. See our Refund Policy for full details.

5. Content Guidelines

You are responsible for all content submitted through your events. You agree not to submit or allow content that:

• Is illegal, harmful, threatening, abusive, harassing, defamatory, or obscene
• Infringes on intellectual property rights of others
• Contains malware, viruses, or harmful code
• Promotes illegal activities or violence
• Contains personal information of others without their consent
• Is spam, advertising, or promotional material (unless you own the event)

Event hosts are responsible for moderating content submitted to their guestbooks. We reserve the right to remove content that violates these guidelines.

6. Intellectual Property

6.1 Your Content

You retain ownership of content you submit to Heyvento. By submitting content, you grant us a limited license to store, process, display, and transmit that content as necessary to provide our services.

6.2 Guest Content

Guests retain ownership of their submitted messages. By submitting content to an event, guests grant the event host and Heyvento a license to store, display, and use that content in connection with the event.

6.3 Our Content

The Heyvento platform, including its design, features, code, and branding, is owned by Heyvento and protected by intellectual property laws. You may not copy, modify, or distribute our platform without permission.

7. Acceptable Use

You agree not to:

• Use our services for any illegal purpose
• Attempt to gain unauthorized access to our systems
• Interfere with or disrupt our services
• Reverse engineer or decompile our software
• Use automated systems to access our services without permission
• Resell or redistribute our services without authorization
• Impersonate others or provide false information
• Circumvent any usage limits or restrictions

8. Privacy

Your privacy is important to us. Please review our Privacy Policy to understand how we collect, use, and protect your information.

9. Service Availability

We strive to maintain high availability of our services. However, we do not guarantee uninterrupted access. We may:

• Perform maintenance that temporarily affects service availability
• Modify or discontinue features with reasonable notice
• Experience outages due to factors beyond our control

10. Limitation of Liability

TO THE MAXIMUM EXTENT PERMITTED BY LAW:

• Our services are provided "as is" without warranties of any kind
• We are not liable for any indirect, incidental, special, or consequential damages
• Our total liability is limited to the amount you paid us in the past 12 months
• We are not responsible for content submitted by users or guests

Some jurisdictions do not allow certain limitations, so these may not fully apply to you.

11. Indemnification

You agree to indemnify and hold harmless Heyvento, its officers, directors, employees, and agents from any claims, damages, or expenses arising from your use of our services, your content, or your violation of these Terms.

12. Termination

You may close your account at any time by contacting us. We may suspend or terminate your account if:

• You violate these Terms
• Your account is used for illegal activities
• We are required to do so by law
• We discontinue the service (with notice)

Upon termination, your right to use our services ends. You may request export of your data before closure.

13. Dispute Resolution

Any disputes arising from these Terms or your use of our services will be resolved through:

• Good faith negotiations between the parties
• If negotiations fail, binding arbitration under the rules of the American Arbitration Association
• Class action waiver: You agree to resolve disputes individually, not as part of a class action

14. Governing Law

These Terms are governed by the laws of the State of Delaware, without regard to its conflict of law principles. Any legal proceedings must be brought in the courts located in Delaware.

15. Changes to Terms

We may modify these Terms at any time. We will notify you of material changes by email or through our platform. Your continued use of our services after changes become effective constitutes acceptance of the updated Terms.

16. Miscellaneous

• Entire Agreement: These Terms, along with our Privacy Policy, constitute the entire agreement between you and Heyvento
• Severability: If any provision is found unenforceable, the remaining provisions remain in effect
• Waiver: Our failure to enforce any right does not waive our right to enforce it later
• Assignment: You may not assign your rights under these Terms without our consent
